Terms and Conditions

The following terms and conditions (“Terms & Conditions” or “Terms” or “T&Cs”) contain “Terms of Use” and “Privacy Policy” govern all use of the simsin.com.pk/parho e-portal (the “e-portal”), including any use or viewing of any Content, services and products available at or through the e-portal (collectively, “Services”), by e-portal visitors and participants (collectively, “Users”), both unregistered and registered users. The e-portal is owned and operated by ARWAJ Solutions (Pvt.) Limited, the “Company” having registered office in Karachi, Pakistan.

If you wish to use this e-portal or employ the Company for any Services, you must agree to the T&C as the exclusive basis which governs usage of the e-portal and provision of Services. If you do not agree to any of the terms, do not use this e-portal or employ the Company for any Services.

Changes to our Terms & Conditions

We reserve the discretion to update this T&C at any time. If we decide to change our T&C, we will post those changes on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it. You acknowledge and agree that it is your responsibility to review this T&C periodically and become aware of modifications.

Below we set out our privacy policy which will govern the way in which we process any personal information that you provide to us.

Information we collect about you & your clients

When you use e-portal, we may collect and store your personal information provided by you. Our primary goal in doing so is to provide you a safe, efficient, smooth experience. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personally identification information, except that it may prevent them from engaging in certain related activities.

The information provided by you at the time of signing in will be stored with us. We may collect personally identifiable information (email address, name, phone number, gender, profile photo) collectively referred as “Personal Data” from you when you set up an account with us by registering.

Using information

Collecting your personal information helps the Company to better understand what you need from us. We use this information to improve customer service, personalize user experience and send periodic email. Information you provide helps us respond to your customer service requests and support needs more efficiently. We may also use this information in the aggregate to understand how our Users as a group use the services and resources provided in our e-portal.

Your personal information is safe with us and will never be released to companies outside the Company.

Disclosing information

We do not sell, trade, or rent Users personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates for the purposes outlined above. We may use third party service providers to help us operate our business and the Site or administer activities on our behalf, such as sending out newsletters or surveys. We will never disclose user’s information to anyone outside the Company except where we have user’s consent, where we are required or permitted to do so by law, order of the court or other legal and statutory process; to other companies who provide a service to us; or any successors in title to our business.

TERM OF USE:

User Terms

In registering for this e-portal, the User must provide true, accurate, current and complete Registration Details which the User must update after any changes (except age) before using the e-portal for further services in the future, the User hereby warrants to the Company that it is at least eighteen years of age and legally able to enter into contracts.

The Company reserves the discretion to withdraw any Material from the e-portal without prior notice and to refuse any Material / Information posted / uploaded by a User.

The Company reserves the right to suspend / block or terminate a User's account where, in its absolute discretion, it deems such suspension appropriate. In the event of such suspension or termination, the Company will notify the User by email (if provided by User) and the User must not seek to re-register either directly or indirectly through a related entity.

The Company owns all Intellectual Property Rights in the e-portal and the Service either register or un-registered, including without limitation, the design, text, graphics, the selection and arrangement thereof.

The following restrictions shall apply to all Users:

User agrees not to transmit any material designed to interrupt, damage, destroy or limit the functionality of the e-portal or the Service.
User agrees not to use any automated software to view the Service without consent and to only access the Service manually.
User agrees not to use the Service other than for its own personal use.
User shall not be entitled to delete any advertisement/listing for a period of 24 hours after posting on the e-portal by said user where option given by the Company.
User agrees not to attempt to copy any Material or reverse engineer any processes without the Company written consent.
User agrees not to use any Service in any manner that is illegal, immoral or harmful to the Company.
User agrees not to use any Service in breach of any policy or other notice on the e-portal.
User agrees not to remove or alter any copyright notices that appear on the e-portal.
User agrees not to publish any Material that may encourage a breach of any relevant laws or regulations.
User agrees not to interfere with any other User's enjoyment of the e-portal or the Service.
User agrees not to conduct itself in an offensive or abusive manner whilst using the e-portal or the Service.

The Company permits the User to post Material on the e-portal in accordance with the Company's procedures provided that Material is not illegal, obscene, abusive, threatening, defamatory or otherwise objectionable to the Company.

Limitation of Liability

The Company will make all reasonable efforts and technical measures so that the Services and access to the e-portal can take place smoothly and without interruption and that an adequate level of security is maintained. However, the Company does not guarantee that the Services and the e-portal will be available without interruption and without errors.

The Company is not liable, though, if for any reason, negligence included, despite the maintained security measures adopted by the Company, the operation of the e-portal is interrupted or access to the e-portal or the User Profiles becomes difficult and / or impossible or if viruses or other harmful software is identified and transmitted to the terminals of the users / visitors, or if third unauthorized parties intervene in any way to the Content and operation of the e-portal making the use of it difficult or causing problems to its proper function. Moreover, we are not liable if the e-portal is not accessible for reasons beyond our control as well as for reasons due to technical or other failure of the backbone network or for reasons of force majeure or incidental facts.

The Company is not liable for any failure in respect of its obligations hereunder which result directly or indirectly from failure or interruption in software or services provided by third parties. The Company is not responsible for the direct or indirect consequences of a User linking to any other website from the e-portal.

No matter how many claims are made and whatever the basis of such claims, The Company's maximum aggregate liability to a User under or in connection with this T&C in respect of any direct loss (or any other loss to the extent that such loss is not excluded by above Clauses or otherwise) whether such claim arises in contract or in tort shall not exceed a sum equal to the value of any amount paid to the Company by the User in relation to which such claim arises.

Warranties and Indemnity

The User hereby agrees to indemnify the Company against all liabilities, claims and expenses that may arise from any breach of this Agreement by the User. All warranties, express or implied, statutory or otherwise are hereby excluded.

We may use third-party advertising companies to serve ads when you use our e-portal. These companies may use information (not including your name, address, email address, or telephone number) about your visits to this and other websites to provide advertisements about goods and services of interest to you.

Choice/ Opt out

We provide all users with the opportunity to opt-out of receiving non-essential (promotional, marketing-related) communications from us on behalf of our partners, and from us in general, after setting up an account.
